Madhuku blames lack of citizen activism for failing to block Amendment Bills - that's rich, who gave Zanu PF legitimacy W Mukori

Professor Lovemore Madhuku, a constitutional law Professor and NCA presidential candidate in the July 2018 elections has expressed his doubts in the many legal challenges producing the desired result of stopping the enactment of the Zimbabwe Constitution Amendment Bills No 1 and 2. As far as he is concerned, the only solution is streets in protests.

"There are two remedies to challenge the two constitutional amendments. There is the political remedy, which is always the best. Citizens would say no to the amendments and organise a political action to challenge them,” he argued.

"There is no sufficient political activity in Zimbabwe at the moment, which explains why we are opting to go to the courts. In a normal framework where there is political activity, we would not have been having these discussions in a small corner, with few individuals who have always been vocal on those matters."

This is just typical arrogance of Zimbabwe’s corrupt and incompetent political leaders; they have betrayed the ordinary people again and again and are the ones who have dragged the nation into this man-made hell-on-earth. Instead of apologizing to the people and mending their ways they have the chic to blame the people lacking political zeal!

“One man, one vote!” was the rallying call in the fight to end white colonial rule. But when the finish line was in sight Robert Mugabe and his Zanu PF cronies brushed the promise aside and told the people if the party failed to win the 1980 elections, the bush war would continue. The people gave up their cherished right to a meaningful say in the governance of the country and voted to end the war.

Mugabe and company were not content with winning the 1980 elections but used it as the starting point to consolidate their power by systematically erode people’s freedoms and rights including the right to free and fair elections and even the right to live. Zanu PF instigated the 1983 to 1987 Gukurahundi massacre, killing over 20 000, to establish the de facto one-party dictatorship. The regime has murdered a further 10 000 plus to retain the dictatorship.

The people have risked life and limb to elect Morgan Tsvangirai and his MDC friends into power these last 21 years on the understanding the party will bring about the democratic changes to end the Zanu PF dictatorship. Tsvangirai and company, just like Mugabe and his Zanu PF cronies, have too sold-out and have failed to bring about even one democratic reform during the 2008 to 2013 GNU when they had the golden opportunity to do so.  

As if betraying the nation over reforms was not bad enough, MDC leaders have been participating in flawed and illegal elections to win the few gravy train seats Zanu PF offered as bait. They knew that by participating the opposition was giving legitimacy to the vote rigging Zanu PF, as David Coltart, MDC minister in the GNU admitted in his book!

“The worst aspect for me about the failure to agree a coalition was that both MDCs couldn’t now do the obvious – withdraw from the elections,” wrote Senator Coltart.

“The electoral process was so flawed, so illegal, that the only logical step was to withdraw, which would compel SADC to hold Zanu PF to account. But such was the distrust between the MDC-T and MDC-N that neither could withdraw for fear that the other would remain in the elections, winning seats and giving the process credibility.”

SADC leaders literally begged MDC leaders not to participate in the 2013 elections until reforms to stop Zanu PF rigging could be implemented. Their pleas fell on deaf ears.

Professor Lovemore Madhuku and his NCA joined in the July 2028 opposition scramble for the few gravy train seats Zanu PF dangled before them! He was one of the 23 presidential candidates and has since been a very active member of Mnangagwa POLAD – a Mnangagwa initiative to reward the presidential candidates for their participation and thus giving him legitimacy.

Madhuku is right, all the Amendment legal challenges question the constitutional powers of the Zanu PF regime are doomed to fail. Like it or not by participating in the flawed elections Zimbabwe’s opposition have given the vote rigging Zanu PF the legitimacy and mandate to govern the country and that includes changing the constitution.

Professor Madhuku’s proposed solution of public protest to stop the amendments is equally fallacious and doomed to fail. The same public participated in the flawed elections and thus gave Zanu PF the mandate to govern or be it unwittingly. What matters here is that the public gave Zanu PF the mandate to govern and, having given it, cannot expect to take it all away by street protests.

Voter beware! (Voter cave!) Has even more resonance than the more familiar “buyer beware” (caveat emptor!)

Indeed, the public have been warned of the folly of participating in these flawed and illegal elections and it is none other than Madhuku and his fellow opposition opportunists who have deceived the public into participating.

The solution to ending Zanu PF misrule is by stopping Zanu PF fraudulently getting legitimacy in the first place. Do not participate in the flawed elections until the democratic reforms to guarantee free, fair and credible elections are implemented. This was the solution SADC leaders proposed back in 2013 and it is valid now as it was back then.

It really is insane to keep participating in flawed elections to give the vote rigging Zanu PF legitimacy and yet this is exactly what Professor Madhuku and the rest in the opposition want the nation to do. Professor Madhuku, Nelson Chamisa, Tendai Biti and the rest in the opposition camp have all one thing in common greed. It was greed that made them participate in the flawed and illegal elections in the past and the same irresistible force is pulling to participate in the 2023 elections regardless of all the evidence Zanu PF has already rigged the elections.

Whilst Zanu PF has found the time to pass Amendment Bills No 1 and 2, amending no fewer than 30 different sections of the constitution, the party has not had the time to extend the postal vote to 3 million Zimbabweans in the diaspora. How can the 2023 elections be free and fair when 3 out 8 (5 million voted in July 2018) Zimbabweans are once again denied the vote! This political reality did not stop the opportunists Madhuku et al participating in the past and it will not do so in 2023!

Zimbabwe is in this economic and political man-made hell-on-earth not because ordinary Zimbabweans have lacked the political zeal to fight for their freedoms and rights. The people have played their part and many have paid the ultimate price and lost their very lives; but all to no avail because the country’s political leaders have again and again betrayed the nation by selling out on the common causes of freedom, human rights, justice and liberty for selfish greed.

To get out of this hell-hole the people of Zimbabwe must open their eyes and see the country’s political leaders for what they really are – corrupt, incompetent and sell-outs and/or murderous thugs. The most foolish thing Zimbabweans can do is to participate in the 2023 elections with no reforms and give the vote rigging Zanu PF legitimacy. Doing so will only prove Zimbabweans have yet to open their eyes and there is no getting out of the hell-hole until we open our eyes!

    Zimbabweans have been here before, we are just going round and round in circle here. Zanu PF has already denied all the 3 million Zimbabweans in the diaspora the vote. The snail pace in issuing ID cards especially in opposition strongholds is just one more vote rigging move.
    MDC leaders had the opportunity to implement the reforms and stop the curse of rigged elections during the 2008 to 2013 GNU. They wasted the opportunity and ever since they have selling the foolish notion that that the opposition can win Zanu PF rigged elections.
    Free, fair and credible elections are not a privilege but a right by participating we are making it a privilege. By participating we have given the vote rigging Zanu PF legitimacy. Zimbabweans must open their eyes are put an end to this madness.

  2. There are cracks on both ends of the bridge’s tarmac entry points while the structure shakes each time heavy vehicles drive past.
    The ageing Birchenough Bridge, a key tourist attraction, is crying out for attention.
    Locals who use the bridge daily as they walk or drive to and from the business centre, work and school are therefore now living in fear of having the 377-metre long structure crumble underneath them.
    In fact, pedestrians now fear for their safety to the extent that they run past the bridge to avoid being on the structure concurrently with heavy trucks
    Things fall apart! There is a real danger that the years of neglect means the structure is now beyond saving! We need a new bridge!

The urgent application in the High Court by the executive director of an NGO to have Chief Justice Luke Malaba found in contempt of court and jailed is now being heard by just two judges after Justice Webster Chinamora recused himself from the original three-judge bench citing professional reasons.

    Following his recusal, the remaining two judges Justices — Amy Tsanga and Slyvia Chirawu-Mugomba — took a brief adjournment to decide whether to proceed with a two-judge panel. The two later agreed to continue with the hearing, but the counsel acting for Chief Justice Malaba could not agree and sought leave to appeal to the Supreme Court against the decision.

    During the 2008 to 2013 MDC leaders wasted the five years chasing the trivial matters and failed to get even one democratic reform implemented. Whilst this Malaba is important it is a trivial matter compared to the serious matter of Zanu PF rigging the 2023 elections. I would be much happier if these lawyers were suing the regime for failing to register as voters the 3 million Zimbabweans in the diaspora, for example.

    What happens to Malaba will not matter one bit Zanu PF blatantly rig the 2023 elections and get away with it!

We cannot stop Zanu PF going ahead with the flawed and illegal elections we must however make sure the process is seen for what it is - a flawed process with no credibility. and therefore no legitimacy.

    We know the opposition are going to participate no matter how flawed the process happens to be for the sake of the few gravy train seats Zanu PF is giving away as bait. Wee must not let the opposition get away with short the people. The opposition have lost credibility ever since their failure to implement even one reform during the GNU!

  5. Zanu PF has money to buy twin-cab Isuzu truck for the country's 270 chiefs at US$ 30 000 @ giving a total of US$ 81 million but has only managed to buy 600 000 covid-19 vaccines. So far the country has vaccinated 684 264 (1st dose) and 364 340 (2nd dose). We are a sitting duck because Zanu PF has its priority up side down. This is high treason!

    The people of Zimbabwe have risked life and limb to elect MDC leaders into power on the understanding they would implement the democratic changes. MDC leaders have had 21 years, 5 of which in the GNU and yet have failed to implement even one reform. Not one!

    Before the GNU the nation had the clear objective of implementing the democratic reforms to ensure free, fair and credible elections. Since the GNU MDC leaders have abandoned reforms, the nation being asked to participate in flawed and illegal elections of the assumption MDC can win rigged elections. Of course, this is utter nonsense; the nation is being asked to live with the Zanu PF dictatorship because we know there are no limits to what Zanu PF will do to retain power.

    We should revert back to demanding the reforms and the holding of free and fair elections. Just because MDC leaders are too corrupt and incompetent to implement the reforms does not mean no else can implement them.

    I am a Zimbabwean citizen and I am determined to hold MDC leaders to account for selling out by failing to implement the reforms and for the winning rigged elections bulls**t! You have elected to bury your head in the sand and continue to follow the MDC leaders blindly as you have done in the past. That is your choice, a foolish one to be certain, not mine!

Wilbert again I want to alert you that you are a Zimbabwean and part of a solution to our crises. Who in their rite can think that reforms can be done with Zanu PF in power unless you are dreaming. Just witness what is happening with current constitution who stand up to Zanu PF. I think you are still saying Chamisa should.”
      Reforms could and should have been implemented during the 2008 to 2013 GNU because Zanu PF was NOT in power alone and could do as it pleased. Morgan Tsvangirai and his MDC-T and Arthur Mutambara and his MDC-M were partners in that government and SADC leaders were the guarantor this is why it was called GNU – Government of National Unity.
      The primary task of the GNU was to implement the democratic reforms and hold fresh elections which would be free, fair and credible. It was obvious the 2013 elections were not going to be free and fair because no reforms had been implemented that is why SADC leaders wanted those elections postponed. MDC leaders ignored SADC leaders’ advice because Tsvangirai is his idiotic foolishness believed he could win rigged elections.
      Why are you surprised at what Zanu PF is doing to the constitution? By participating in the flawed elections MDC gave Zanu PF legitimacy and as the legitimate government with 2/3 majority Zanu PF can amend the constitution.
      MDC cannot have the cake and eat it too! MDC leaders knew with no reforms Zanu PF would rig the elections and they have agreed to participate regardless. It is foolish for MDC to then complain of Zanu PF rigging when they knew that was going to happen.
      The real reason MDC leaders keep participating in these flawed elections is because they are after the few gravy train seats Zanu PF gives away as bait. By participating MDC give Zanu PF legitimacy and in return Tendai Biti, Job Sikhala and a few others get to be MPs and senators and Chamisa gets a share of the annual Political Party Finance Act pay out. It was the same greed that stopped MDC leaders implementing the reforms during the GNU.
      Zanu PF leaders have known about MDC leaders’ greed all along and have exploited it. Zanu PF will never implement any reforms as long as the party knows the opposition will participate in elections no matter how flawed the process.
      Of course, MDC leaders will never admit they sold-out during the GNU nor will they ever admit they are participating in the flawed elections out of greed. No more than Mnangagwa will ever admit that he rigs elections. It is for the voters to figure out these things for themselves or suffer the consequences. And with voters like you, who have their heads buried in the backsides of the great leaders, you will never figure out anything even if you were given a cat’s nine lives!
      Nations get the government they deserve, we in Zimbabwe certainly deserve this corrupt, incompetent and murderous Zanu PF dictatorship complete with its entourage of corrupt, incompetent and utterly useless opposition parties, all 130 of them at the last count!

    MDC leaders were all clamoring for democratic change, it was the single dominant idea in their heads they could not give a public address without first shouting the slogan "Change! Chinja!" several times. All that changed when they took their seats on the GNU, they were now fully paid up members of the country's exclusive ruling elite with all the privileges, power and influence that entailed. They forgot about reforms and change.

    "Mazivanhu e MDC adzidza kudya anyerere!" (These MDC hypocrites have learnt to enjoy the gravy train good life, they will not rock the boat!) boasted a Zanu PF crony when asked why MDC leaders were not implementing the democratic reforms during the GNU.

    Sure enough MDC leaders failed to implement even one token reform in five years. They were enjoying the gravy train good life and did not want to rock the boat.

    Of course, Mudhuku knew why Tsvangirai and company failed to implement even one reform during the GNU. He also knew exactly why MDC leaders have been participating in elections everyone with half a brain knew were being rigged by Zanu PF - greed. And, most important of all, he knew that by participating MDC was giving the vote rigging Zanu PF legitimacy. Knowing all that, he still decided to join the party and participate in the July 2018 elections for the same reason - GREED!

    Madhuku and his fellow presidential candidate were to be reward with a seat on POLAD and Mnangagwa has given the members generous allowances and perks. In return the members have never said anything critical of the Zanu PF regime. "Vhara muromo!" (Close your mouth!) as one would say in Shona.

    I totally agree Madhuku is being the quintessential a hypocrite and a twat in that he and his fellow opposition opportunists are the ones who gave Zanu PF legitimacy and now he has chutzpah to blame the ordinary people for Zanu PF misrule! What a twat indeed!

  8. Madhuku was honest enough to admit that Zanu PF has the mandate to change the constitution given its 2/3 majority in parliament and senate. He was showing the typical Zimbabwe opposition mentality of participating in the flawed elections, giving Zanu PF legitimacy and then expect the ordinary people to force the regime out of office by staging dangerous street protests! How typical!

  9. RESETTLED farmers not fully utilising their land have been told to surrender their properties or risk losing the farms to other deserving and productive citizens.

    The latest threats were issued by Mashonaland West provincial minister Mary Mliswa-Chikoka Thursday while touring Mucherengi and Summerhill farms in Mhangura.

    The minister said it was time for non-productive farmers to immediately surrender their farms or risk being kicked out of the land.

    The ruling elite who own the big farms are the worst performers. For decades, Gushungo Diary was a bee-hive of activity only because it was heavily subsidized the free bank loans and paid no income tax or sells tax. When Mugabe died the cheap money stopped and the farming stopped!

    These farm seizures will affect the small fish just as the anti-corruption drive has netted the small fish! This is just a waste of time! Zanu PF will never reform itself.

  10. PUBLIC Service, Labour and Social Welfare minister Paul Mavima yesterday revealed that pensioners' payouts would be reviewed upward to US$60 per month by December this year from the current US$25.

    The money will, however, be converted to Zimbabwean dollars at the prevailing official Reserve Bank of Zimbabwe rate, implying they will get ZW$5 440 if the rate remains stable at ZW$85 to the US unit.

    The payout, however, makes only a fraction of the monthly food basket, which this month stands at more than ZW$28 000, according to the national statistical body, Zimstats.

    The development is coming at a time when the government has put new legislation on currency (SI 127 of 2021), which is expected to result in the prices of commodities rising dramatically.

    Mavima, who was speaking during a new National Social Security Authority (Nssa) board induction ceremony, challenged the new board members to ensure that investments produced sustainable incomes.
    The poorer pensioners they are in the same boat as the nurses and teachers, to stop the mother ship Zimbabwe from sinking from the hyperinflation the pensioners, nurses and teachers are the ones who pension and salary are in a rickety row-boat that is falling behind the soaring inflation. The soldiers, Police and CIO rank and file are in a motorised boat that is too falling behind inflation but not far behind. The ruling elite are it the mother ship and those on board do not know about economic hardships.
    The pensioners and nurses are by far better off than the millions now living heart breaking poverty; they have been cast overboard to hang on to driftwood or sink!
    How ironic that Mnangagwa still maintains the country is on course to become a upper middle income nation in 2030, vision 2030. This is it with tyrant and dictatorship the destroy the country and then complain why the ordinary people are poor; as if it is the poor’s fault and they are doing it deliberately to embarrass him!

According to the latest list of 1 423 beneficiaries of the US$1.2 billion allotted under the main foreign exchange auction between June 2020 and 31 May 2021 which was published by the RBZ, the DRC ambassador — who doubles as the dean of African diplomats and is known for rallying counterparts in the diplomatic service to project Zimbabwe in good light especially during chaotic events like elections — accessed US$120 000 from the main auction system.
    To put it into context, at position 992 on the main auction allocation list, Mwanananga, who has no known business interests in Zimbabwe, accessed the same amount of forex as the City of Gweru, one of Zimbabwe’s largest urban centres which is currently being dogged by run down infrastructure and water shortages, among other challenges.
    At US$19 million, agro industrial concern Blue Ribbon Foods received the lion’s share of the allocations. The central bank, which may soon crack the whip on individuals and entities abusing forex accessed from the formal system, said funds accessed from the system would be used for raw materials, machinery and equipment, retail and distribution, among other critical needs.
    Desperate to tame the runaway parallel market and stabilise prices, the central bank introduced the Dutch auction system a few years ago which critics said was heavily managed by the apex bank and benefited only a few individuals and companies.
    At inception, the system benefited large corporates before a second-tier system was introduced for the small to medium enterprises (SMEs).
    Corruption has become so rampant in Zimbabwe that every time someone introduces something ostensibly to improve the system it is soon abandoned because the corrupt have taken over whatever it is. There are reports that private doctors are charging US$ 40 to 100 for a corona virus jab. It is almost certain the said doctors would not have sourced the vaccine on the open market but from someone who got it free or bought using tax-payers’ money. The corrupt are once again profiting from the suffering of others.

  12. The most foolish think Zimbabweans have ever done in the last 20 years was to believe the MDC leaders' lie that the party can win rigged elections, especially when they knew from the 2008 elections that there are no hold-barred as far as Zanu PF rigging was concerned.

    Chamisa et al have had to abandon the fight to implement the reforms to stop Zanu PF rigging because MDC leaders sold-out on reforms during the GNU. But the fact that MDC leaders have proven to be corrupt and incompetent to implement the reforms does not mean the reforms are no longer necessary much less that no one else can implement them.

    Zimbabweans were conned by the MDC leaders into abandoning the fight for democracy and fight to implement the reforms to guarantee free and fair elections because Chamisa and company had devised "stringent measures to stop Zanu PF rigging elections!" After 41 years of rigged elections, the people must now come to their senses and revert to demanding the reforms BEFORE the elections!
